La STP identificará proyectos APP

La Secretaría Técnica de Planificación del Desarrollo Económico y Social (STP) inició un proceso para identificar los proyectos que formarán parte de la nueva cartera de proyectos en la modalidad de Alianza Público Privada (APP).

El análisis se realiza a través de una Matriz de Evaluación de proyectos que contiene una primera parte con un perfil sumamente básico del proyecto y la segunda parte se compone de 14 preguntas de valoración de la situación, que se traducen en un índice que mide la elegibilidad del proyecto como APP.

Este proceso inició con el acercamiento de la Secretaría a los ministerios de línea e instituciones públicas que pueden desarrollar proyectos bajo el formato APP de acuerdo a la tipología de proyectos establecida en el marco legal, el Ministerio de Obras Públicas y Comunicaciones (MOPC), el Ministerio de Salud Pública y Bienestar Social (MSPyBS), la Secretaría Nacional de la Vivienda y el Hábitat, el Instituto de Previsión Social, entre otros.

En el mismo se han identificado los proyectos o ideas de proyectos que estas instituciones desean llevar adelante y que podrían tener características APP. La mayoría de ellos forma parte de sus planes de acción o planes maestros a ser implementados en el corto y mediano plazo. Parte del proceso abarca un análisis de elegibilidad resumido con estos proyectos, de manera a establecer un primer nivel de análisis básico.

Todo el proceso de análisis será validado por las instituciones en un Taller que se realizará una vez que todas las instituciones presenten sus fichas. El objetivo del taller será identificar los proyectos con más características de ser desarrollados bajo la modalidad APP.

APP

Es un instrumento de la política pública paraguaya para generar Infraestructura que acompañe y potencie el crecimiento y desarrollo económico social e inclusivo del Paraguay. Este instrumento se materializa en un contrato de largo plazo entre el Sector Público y el Sector Privado, a fin de desarrollar infraestructura pública y/o prestar servicios a que las mismas estén destinadas o que sean complementarias a ellas, así como en la producción de bienes y en la prestación de servicios que sean propios del objeto de organismo, entidades, empresas públicas y sociedades en la que el estado se parte.

El marco normativo es Ley N° 5.102/13 “De Promoción de la Inversión en Infraestructura Pública y Ampliación y Mejoramiento de los Bienes y Servicios a cargo del Estado” y su Decreto Reglamentario Nº 1.350 del 12 de marzo de 2014. Los contratos de participación público privada se regirán por los términos y condiciones del contrato, las disposiciones de la Ley 5.102/13, de su Decreto reglamentario y le serán aplicables supletoriamente las disposiciones del Código Civil en todo cuanto no esté previsto en la Ley, Reglamento y contratos mencionados.
